1. About these terms

These terms are an agreement between you and LDC LMT DIGITAL CREATIONS ("we"), publisher of Amoenia (details in the legal notice). By creating an account, you accept them.

2. The service

Amoenia helps independent retreat organizers plan the money side of a retreat: budget, break-even, guests and payments.

Amoenia is in early access: features will change, and some may be added or removed. It is intended for organizers acting in a professional capacity, whether as a company, self-employed or through an association.

3. Plans and payment

The free plan includes one retreat for the life of your account: deleting it does not give it back. Amoenia Pro, a monthly or yearly subscription, gives unlimited retreats and the full dashboard. A one-time purchase of one more retreat may also be offered in the app.

Prices are shown in the app and exclude VAT, which is added at checkout where it applies. Payments are handled by Stripe: your purchase is sold through Link, Stripe's merchant of record, which collects the payment and the taxes and sends your receipts and invoices. Link's terms also apply to the payment itself.

A subscription renews automatically at the end of each period until you cancel it. You can cancel at any time from the app (Plan, then Manage subscription) or from your Link account, and you keep Pro until the end of the period already paid. For a refund request, write to us or to Link support; where the law gives you a right of withdrawal, it applies.

4. Your account

  • You sign in with your Google account. You must be at least 18.
  • An account is for one person. Keep access to your Google account secure: what happens under your account is your responsibility.

5. Your content

The retreats, figures, guests and payments you enter remain yours. You give us the right to store and process them only to run the service for you. We do not use them for anything else and we do not sell them.

6. Your guests' data (data processing terms)

For the personal data of your guests, you are the controller and we are your processor within the meaning of Article 28 of the GDPR. The data concerned is the names, email addresses, booking status, prices, payments and notes of the guests of your retreats, kept for as long as your account exists. We commit to:

  • process it only to provide the service, following your instructions as given through the app;
  • keep it confidential: only the people who need access to run the service have it, and they are bound by confidentiality;
  • protect it with appropriate security measures (see section 7 of the privacy policy);
  • use only Hostinger International Ltd. (hosting, European Union) as a sub-processor; we will tell you before adding or replacing a sub-processor, and you may object by closing your account;
  • help you answer your guests' requests and meet your own obligations, as far as our role allows;
  • notify you without undue delay after becoming aware of a personal data breach affecting your data;
  • delete the data when you delete it or close your account (within 30 days, backups aside), or return it to you on request beforehand;
  • give you, on request, the information needed to show that these commitments are respected.

On your side, you tell your guests that you use Amoenia to manage your bookings, you make sure you have a legal basis, and you only record what you need. Do not record health information (allergies, medical conditions) unless your guests have given their explicit consent, and never record card numbers or bank details in notes.

7. Figures and calculations

Break-even, profit and suggested prices are estimates calculated from what you enter. They are planning aids, not financial, tax, accounting or legal advice. Check important figures before making a decision.

Amoenia does not collect payments from your guests: the payments recorded in the app are your own records.

8. Acceptable use

Do not use Amoenia for anything unlawful. Do not try to access other people's data, disrupt the service, test or bypass its security, scrape it or overload it, and do not store content you have no right to store.

9. Availability

We do our best to keep the app available and your data safe. During early access we cannot guarantee an uninterrupted service or error-free figures, and maintenance may cause short interruptions. Keep your own copy of anything critical.

10. Closing your account

You can stop using Amoenia at any time. You can delete your account yourself in the app, under Profile, or ask us to do it by writing to info@amoenia.com. Deleting the account cancels any subscription at once, without refund of the current period.

We may suspend or close an account that seriously or repeatedly breaches these terms, after a warning unless the situation is urgent. If we stop the service, we will give you at least 30 days' notice, send you your data on request and refund the unused part of any prepaid subscription.

11. Liability

We are liable for damage caused by our fault, to the extent required by law. We are not liable for indirect losses, such as lost profit or lost bookings, nor for decisions you make based on the figures. Our total liability is limited to the amount you paid us in the 12 months before the event, or 100 € if you paid nothing.

Nothing in these terms limits our liability for gross negligence, intentional misconduct, or anything that cannot legally be limited.

12. Intellectual property

The software, design, texts and the Amoenia brand belong to us. While your account is open, you have a personal, non-exclusive right to use the app.

13. Changes to these terms

We may update these terms. For significant changes, we will tell you by email or in the app at least 15 days before they apply. If you disagree, you can close your account.

14. Applicable law and disputes

These terms are governed by French law. If something goes wrong, write to us first and we will look for an amicable solution. Failing that, disputes between professionals go to the courts of Nantes, France. If you are a consumer, you keep the protection of the mandatory rules and courts of the country where you live.
